Colorado HomeFinder Terms & Conditions

1. I represent and warrant that I am eighteen (18) years of age or older, and legally competent to make this Agreement.
2. I represent and warrant that I am a bona fide buyer of real estate who is not a party to an exclusive brokerage services agreement with any other real estate broker, agent, or firm. I do not have a contract or agreement with another real estate agent or agency such as a buyer's agency agreement.
3. I agree to immediately notify Colorado HomeFinder in the event that I enter into an agreement with another real estate broker.
4. I do not hold any type of real estate license in the state of Colorado, including, but not limited to, a employing broker license or an associate broker license.
5. I understand that all of the home data provided by Colorado HomeFinder is for my sole and personal use and not available for distribution. I will not sell or use the data provided by Colorado HomeFinder for any purpose, other than the purpose of attempting to evaluate houses or properties for sale or purchase.
6. I understand that Colorado HomeFinder has not entered into any form of fiduciary or brokerage relationship with me solely by granting me access to, and use of, the Site Materials available on the Colorado HomeFinder website.
7. I understand and agree that the contact between me and Colorado HomeFinder, or any of the real estate brokers to whom I am referred by Colorado HomeFinder, is casual and preliminary in nature, and that I have not entered into any form of fiduciary or brokerage relationship solely by reason of the information that I have provided. A fiduciary or brokerage relationship does not exist unless and until the broker assists me in procuring a real estate sales contract. At such time as a broker shows me property or I request assistance in arranging a real estate transaction, the broker will disclose to me the nature and extent of any duties and obligations as required by Colorado state laws and the Colorado Real Estate Commission. At such time, I may elect to enter into a brokerage relationship with this broker. Any brokerage relationship that I agree to enter into will be solely between me and the broker and his or her brokerage. Colorado HomeFinder will not be party to this brokerage relationship. I understand that I am under no obligation to work with any broker referred by Colorado HomeFinder.
8. By registering, I consent to receive personalized emails from Colorado HomeFinder. Our current privacy policy is available at Colorado HomeFinder Privacy Policy.
9. I agree to limit my online search to houses or properties within my anticipated purchase ability or price range and to the properties that meet my other criteria.
10. I agree that I will not attempt to contact the seller of any property that I have identified by using the Colorado HomeFinder website, and that I will not attempt to enter onto any such property except through an appointment arranged by Colorado HomeFinder or a broker referred by Colorado HomeFinder.
11. The links, URLs, or icons of other websites may be displayed on the Colorado HomeFinder Website. Any content, representations, or warranties made on such other websites are the sole responsibility of said Websites. Colorado HomeFinder assumes no responsibility, liability, or obligation for such content, representations, or warranties of any kind, express or implied.
12. I agree to abide by all copyright restrictions placed on the content of the Colorado HomeFinder website including, but not limited to, any material or data compilations where Colorado HomeFinder or others hold the copyright.
13. To the fullest extent permitted by law, the service is provided "as is," without warranty or representation of any kind, either express or implied, as to (1) the operation of the Website, (2) the information, data, services, or products provided through or in connection with this service or (3) the ability, quality or reliability of any third party service provider accessed through or in conjunction with the use of this service.
14. Colorado HomeFinder expressly disclaims any representations or warranties concerning the accuracy or reliability of the data provided by Colorado HomeFinder or the content available on the Website. I agree that any and all data and site materials are provided to me in an "as is" condition, with no warranty of merchantability or fitness for a particular purpose.
15. I agree that Colorado HomeFinder shall not be liable to me for any damages of any kind whatsoever by reason of my reliance upon or use of the data provided by Colorado HomeFinder or the content of the Website, including any punitive, compensatory, special, consequential, or exemplary damages, or fines or assessment.
16. I agree to defend, indemnify, and hold harmless Colorado HomeFinder from any damages, costs, and expenses, including attorneys fees and litigation costs and expenses at trial or on appeal, arising from any claim by a third party based upon my use or display of the data provided by Colorado HomeFinder or the content of the Website.
17. I agree that this Terms of Use Agreement shall be governed by the laws of the State of Colorado applicable to contracts made and performed entirely in the State. If Colorado HomeFinder prevails in any suit against me to enforce its rights under this Terms of Use Agreement, I agree that the Court may enter an award on behalf of Colorado HomeFinder and against me for Colorado HomeFinder's reasonable attorney's fees, costs, and litigation expenses associated with such suit, or the appeal of any judgment or award rendered on behalf of Colorado HomeFinder.
